LANSING - Ingham County Circuit Court Judge Joyce Draganchuk ordered the Michigan Board of Canvassers to stop the retabulation of the Detroit mayoral primary election votes.
Judge Draganchuk issued a temporary restraining order, Aug. 29, to halt the election review process after a lawsuit was filed claiming that the Board went beyond the state constitution in their process of retabulating the write-in votes. The lawsuit was filed by Detroit City Clerk candidate D. Etta Wilcoxon.
Judge Draganchuk's order has put the certification of the election on hold. A show cause hearing in Lansing is scheduled for Sept. 3, the day the state was to certify the Detroit election.
The state Board of Canvassers, by default became responsible for certifying the Detroit election when the Wayne County Board of Canvassers refused to certify the votes due to a massive discrepancy between unofficial results posted by the Detroit City Clerk and the findings of the Wayne County Election Division.
City Clerk Janice Winfrey, the night of the Aug. 6 primary, released an unofficial count of 44, 395 votes for write-in candidate Mike Duggan and 28,352 votes for Sheriff Benny Napoleon. The official number from the County Board of Canvassers for Duggan was 23,970, placing him second to Napoleon with 28,891.
